Membership Agreement & Terms of Use

The following information will outline membership benefits, your role as a member, and our responsibility to you. When you click on the button to purchase the membership, this will constitute your agreement with these terms.

Use of Service

How the Membership Program Works. The Emotion Guide™Collective is a membership community hosted on Mighty Networks. The Emotion Guide™ Collective will provide content for you to learn, engage, and have fun with others throughout your membership.

Registration. You will register your account for the Emotion Guide™ Collective. Your personal data information will not be kept by the Emotion Guide™ Collective but by Mighty Networks. You must be 18 years or older to be apart of the membership community.

Payments. Your payment(s) will be process through Stripe. You agree to pay the monthly or annual rate in effect at the time you joined. Applicable taxes and fees may apply. 

Membership Benefits

If you join this awesome membership community this is what you can expect from us :

  1. Access to our zero-distraction community so you can get answers, ideas and inspiration.
  1. Invitations to online Emotion Guide™ Talks on subjects such as but not limited to anxiety, anger, disappointment, perfectionism, negative thinking, and self-compassion.
  1. Access to our app (available via Apple Store or Google Play) so you can take your support wherever you go.
  1. Exclusive invitation to members-only virtual events; like roundtable discussions, Q & A’s, and guest expert presentations.
  1. Access to downloadable hands-on activities for children on themes focused on emotion awareness, coping, and communication tools. 
  1. Access to local members so that you can meet fellow Emotion Guides in your area.
  1. Access to a growing community where you know you’re not alone in your efforts to guide your children. You give a lot; this is a place where you can replenish your cup.

Community Guidelines

To remain a member in good standing:

  1. You promise not to break any laws while using our membership site. Meaning you engage in any hacking or any type of data stealing;
  1. You promise not to steal and of our content in the membership portal outside of personal use. Meaning you won’t sale our content;
  1. You promise to follow the non-harassment policy posted in the community;
  1. You promise to not spam the community or community members;
  1. You promise to not share membership materials with anyone that is not a member;
  1. You will not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
  2. You can use the information in the membership community for your personal use, but you may not use the information for resale purposes or receive remuneration for materials inside the membership. 

Trademarks & Copyrights

We love being able to offer you quality content for personal use; however, allowing you to use our content does not mean you own our content. We will allow you to use our membership materials for personal use, but not for profitable use. Everything we post in the membership community for you to use belongs to us. Your Communication(s)

Any communication(s) made through our ‘contact,’ blog, blog comments, newsletter sign up or other related pages, or directly to our phones or mailing or email addresses is not held privileged or confidential and is subject to viewing and distribution by third parties. 

We own any and all communications displayed on our website, servers, comments, emails or other media as allowed by United States law, and will not give credit or pay royalties for unsolicited user-generated content such as blog comments or emails. For more information on when and how we store and use your communications or any data provided by you in those communications, please refer to our Privacy Policy.

We maintain a right to republish any submission in whole or in part as reasonably necessary in the course of our business. You agree not to submit any content or communications that could be illegal or serve an unlawful purpose, including, but not limited to communications that are potentially libelous or maliciously false, obscene, abusive, negligent or otherwise harmful or inappropriate.

Disclaimers and Limitation of Liability

THE CONTENT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING THAT THE WEBSITES WILL OPERATE ERROR-FREE OR THAT THE WEBSITES, THEIR SERVERS, OR THE CONTENT ARE FREE OF COMPUTER VIRUSES OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES.

THE WEBSITES MAY CONTAIN TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS OR OMISSIONS. UNLESS REQUIRED BY APPLICABLE LAWS, WE ARE NOT RESPONSIBLE FOR ANY SUCH TYPOGRAPHICAL, TECHNICAL, OR PRICING ERRORS LISTED ON THE WEBSITES. THE WEBSITES MAY CONTAIN INFORMATION ON CERTAIN PRODUCTS AND SERVICES, NOT ALL OF WHICH ARE AVAILABLE IN EVERY LOCATION. Indemnification

As a member you agree to release, indemnify and defend the Emotion Guide™ Collective doing business as Emotionanigans, LLC, from all third-party claims and expenses as it relates to your breach of this membership agreement.

In the event that you break any of the rules of this agreement we have the right to retrieve any monies from you due to the breach.

Your Legal Remedies

It is our hope they we never get to the point of legal action with any of our members. If this is the destination you agree to resolve your problem with us through a binding arbitration. 

If after 30 days we cannot solve your problem for you. Please send any complaints or issues you may be having to : kim@growingupconfident.com

It is our goal to provide you the best customer service. If we cannot provide that the next step is to choose an arbitration panel in North Carolina. 

What Law Applies?

The Emotion Guide’s website is based in the United States. North Carolina state laws and federal law will govern our agreement. The General Date Protection Regulation applies to our UK based members. 

Termination of Membership

Emotionanigans, LLC or anyone authorized to represent Emotionanigans, LLC can terminate your membership without any refunds. We are committed to creating a safe and open culture. If you break any of the community rules or disrupt the community, you will be removed from the membership.

Cancellation Policy

You can cancel your membership subscription and the leave the Emotion Guide™ Collective at any time.

To cancel, just log into the Emotion Guide™ Collective on Mighty Networks and go to Profile> Settings >Account.  Scroll down until you see the button that says Manage Your Subscription. Then, choose the option to Change Subscription.On the next page, you’ll see an option to “Cancel your subscription.” Click on that link and confirm that you do indeed want to cancel, and then your subscription will be cancelled at the end of the current billing period.

Our Refund Policy

Due to the nature of the services and or products we provide, refunds will not be given unless otherwise specified in writing by an authorized representative of the Emotion Guide™ Collective.

Our Agreement

Everything outlined here is what we promise to one another. Anything outside of this agreement is invalid.

The purpose of the Emotion Guide™ Collective membership is for educational purposes only. No outcomes are promised or guaranteed. No content is intended to be a substitute for professional medical or psychological diagnosis, advice or treatment. Information provided does not create an agreement for service or any type of professional relationship between, Kimberly Restivo, MA, LPC, PLLC or Kim Restivo Lange and any group member.

The information on this site will not be considered to create a counselor/therapist relationship. Visitors and members agree and understand Kim Restivo Lange is not providing the professional services of an attorney, accountant, nutritionist, financial planner, therapist, or any other kind of licensed or certified professional. Although she is a licensed professional counselor, she does not provide behavioral or mental health services within the membership. Consult a physician or qualified professional regarding the applicability of any opinions or recommendations with respect to symptoms of a medical or behavioral health diagnosis. Children or adults who show signs of dangerous behavior towards themselves or anyone else, should be placed immediately under the care of a qualified professional.

Any abuse perceived throughout the community will be reported to the appropriate authorities due to the mandating reporting law.
